
GENERAL TERMS
AND CONDITIONS
PART 1 – GENERAL PROVISIONS
1. SCOPE
These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) apply to all contracts between Future of Fitness UG (haftungsbeschränkt) (hereinafter referred to as “Kairos”, “we” or “us”) and its customers concerning the use of the services offered. These include, in particular: * memberships, * individual bookings (drop ins), * class packs, * workshops, events and special classes, * retreats, * 1:1 sessions as well as coaching and breathwork services, * longevity and wellness treatments, * gift vouchers, * purchases of goods from the online shop and the on site Wellness Store, * any other services offered by Kairos. Any deviating terms and conditions of the customer shall not apply unless their applicability has been expressly agreed to in writing.
2. CONTRACTING PARTY

3. CONCLUSION OF CONTRACT
The presentation of our services on our website, through our booking system, at the studio or via other communication channels does not constitute a legally binding offer, but rather an invitation for the customer to submit an offer. The contract is concluded only upon acceptance of the booking by Kairos or upon receipt of a booking confirmation through the booking platform used. By completing the booking, the customer confirms that they have read and accepted these Terms and Conditions as well as the prices applicable at the time of booking.
4. BOOKING PLATFORM
Kairos uses a digital booking and management platform for bookings, payments, memberships, class credits, gift vouchers, waiting lists and the management of customer accounts. The platform currently in use will be specified on our website. Customers are responsible for ensuring that the personal information provided in their customer account is complete and kept up to date. Login details for the customer account must be kept confidential and must not be shared with third parties.
5. SERVICES OFFERED
Kairos offers a range of services in the areas of movement, recovery, holistic wellbeing and community. The exact scope of each service is set out in the current service description on our website or within the booking system. These services include, in particular: * yoga and movement classes, * breathwork and embodiment sessions, * workshops and events, * memberships, * individual bookings, * class packs, * longevity and wellness treatments, * retreats, * personal sessions, * coaching services, * gift vouchers, * the sale of goods through the online shop and the Wellness Store. Kairos reserves the right to develop, modify or adapt its range of services within reasonable limits, or to temporarily or permanently discontinue individual services, provided that this does not result in a breach of any material contractual obligations.
6. PRICES AND PAYMENT TERMS
The prices published at the time of booking shall apply. All prices include the applicable statutory VAT, where applicable. Payment shall be made using the payment methods available through the booking system. Unless otherwise agreed, customers shall only be entitled to participate in or receive a service once payment has been successfully received.
PART 2 – MEMBERSHIPS & BOOKINGS
7. MEMBERSHIPS
Kairos offers various memberships with different contract terms and scopes of services. The services included, the number of class credits included and the applicable membership fee are determined by the service description and price list valid at the time the contract is concluded. Memberships are personal and may not be transferred to another person. 7.1 OPENING SPECIAL MEMBERSHIP The Opening Special Membership is a one time introductory offer for new customers during the promotional period specified by Kairos. The minimum contract term is six (6) months. After the minimum contract term has expired, the membership will automatically continue as an Essential Membership under the terms and conditions applicable at that time, unless it has been terminated within the applicable notice period. The Opening Special Membership may only be purchased once per person. 7.2 ESSENTIAL MEMBERSHIP The Essential Membership has a minimum contract term of six (6) months. After the minimum contract term has expired, the membership will continue for an indefinite period and may thereafter be terminated on a monthly basis. 7.3 FLOW MEMBERSHIP The Flow Membership has a minimum contract term of three (3) months. After the minimum contract term has expired, the membership will continue for an indefinite period and may thereafter be terminated on a monthly basis. 7.4 UNLIMITED MEMBERSHIP The Unlimited Membership has a minimum contract term of one (1) month. After the minimum contract term has expired, the membership will continue for an indefinite period and may thereafter be terminated on a monthly basis. 7.5 TERMINATION A membership may be terminated via the customer account within the booking platform or by notifying Kairos in text form. After the respective minimum contract term has expired, the membership may be terminated with one month’s notice effective at the end of a calendar month. If the membership is not terminated within the applicable notice period, it will continue for an indefinite period and may thereafter be terminated with one month’s notice effective at the end of a calendar month. The statutory right to terminate the contract for good cause remains unaffected. 7.6 SUSPENSION OF MEMBERSHIP As a general rule, memberships cannot be suspended. An exception applies in cases where a customer is medically unable to participate for an extended period of at least four (4) consecutive weeks and provides appropriate medical documentation. The relevant documentation must be submitted to Kairos before the requested suspension begins. During an approved suspension period, the contractual services will be suspended. The contract term will be extended accordingly by the duration of the approved suspension. Memberships cannot be suspended due to holidays, private travel or short term illness.
8. CLASS PACKS
Kairos offers class packs with a specified number of class credits. The respective scope of services is set out in the current service description. Class Packs are personal and may not be transferred to another person. Unused credits expire at the end of their respective validity period. 8.1 ESSENTIAL PACK The included credits are valid for three (3) months from the date of purchase. 8.2 FLOW PACK The included credits are valid for six (6) months from the date of purchase.
9. DROP-INS
Drop ins entitle the customer to participate once in the booked class. The booking is valid exclusively for the selected class and scheduled date and time and may not be transferred to another person.
10. GIFT VOUCHERS
Gift vouchers may be purchased online or at the Wellness Store. They may be redeemed for any services offered by Kairos, unless otherwise agreed at the time of purchase. Gift vouchers are valid for twelve (12) months from the date of issue. Cash redemption of the voucher value is excluded to the extent permitted by law.
PART 3 – CLASSES & STUDIO OPERATIONS
11. CLASS BOOKINGS & RESERVATIONS
Participation in classes generally requires prior booking through the booking platform used by Kairos. The number of available spaces is limited. Customers are not entitled to participate in a specific class or attend a class with a specific instructor. Kairos reserves the right to change class times, instructors, rooms or class content for organisational reasons, provided that such changes are reasonable for participants.
12. WAITING LIST
If a class is fully booked, customers may join the waiting list through the booking platform. If a space becomes available, customers will automatically be moved into the class according to their position on the waiting list. Once a customer has been successfully moved into the class, the booking becomes binding. From that point onwards, the standard cancellation terms set out in these Terms and Conditions shall apply. Customers are responsible for regularly checking the status of their booking and for monitoring notifications from the booking platform.
13. CANCELLATIONS
A booked class may be cancelled free of charge up to twelve (12) hours before the scheduled start of the class. The time at which the cancellation is received through the booking platform shall be decisive. For cancellations made less than twelve (12) hours before the scheduled start of the class, a Late Cancellation Fee of €15.00 will apply. Kairos reserves the right to charge this fee using the payment method stored in the customer’s account.
14. NO SHOW
If a participant does not attend a booked class without cancelling in advance, the booking will be considered a No Show. In this case, the booked class will be forfeited. No refund, credit or rebooking will be provided.
15. PUNCTUALITY & ADMISSION
To ensure that all classes run smoothly and safely, Kairos asks all participants to allow sufficient time for check in and arrival. Out of consideration for the group and for organisational and safety reasons, admission may be refused once a class has started. In such cases, there is no entitlement to a refund or participation in an alternative class.
16. CHANGES TO THE CLASS SCHEDULE
Kairos reserves the right to modify class offerings, class times, instructors or locations for organisational reasons. If a class is cancelled, customers will be informed in a timely manner wherever possible. In such cases, any individual bookings already paid for or the corresponding class credits will be credited or refunded. Any further claims shall only apply to the extent provided for by law.
17. HOUSE RULES & CONDUCT IN THE STUDIO
Kairos is intended to be a space of mindfulness, mutual respect and community. All participants are required to treat one another, the Kairos team, the premises and all facilities and equipment with respect. Instructions given by the Kairos team must be followed in order to ensure a safe and pleasant studio environment. Photography, filming and phone calls are not permitted during classes. Mobile phones must be set to silent during all classes. Pets are only permitted in the café and Wellness Store areas. Animals are not permitted in the class rooms or in the longevity and wellness areas. Participation in all services and activities offered by Kairos is restricted to persons aged eighteen (18) or over.
18. RIGHT OF ADMISSION
Kairos reserves the right to temporarily or permanently exclude individuals from using some or all of its services where there are objective grounds for doing so. Such grounds include, in particular: * repeated or serious violations of these Terms and Conditions or the house rules, * aggressive, discriminatory or disrespectful behaviour, * harassment of other participants or staff members, * intentional damage to property, * participation while significantly under the influence of alcohol or intoxicating substances, * any other conduct that compromises the safety, health or wellbeing of others. Any exclusion shall not affect payment obligations that have already arisen.
PART 4 – HEALTH, WELLNESS & SPECIAL SERVICES
19. HEALTH & PERSONAL RESPONSIBILITY
Participation in all services and activities offered by Kairos is voluntary and generally at the participant’s own responsibility. By booking and participating in a service, the customer confirms that they are physically and medically fit to take part in the respective service. The services offered are intended to promote movement, relaxation, recovery and general wellbeing. They do not constitute medical or therapeutic treatment and are not a substitute for medical diagnosis, medical treatment or psychotherapy. Each participant is required to inform Kairos before the start of a service of any health conditions, injuries, pregnancy or other circumstances that may be relevant to the safe provision of the booked service. Kairos reserves the right to refuse or discontinue an individual’s participation for health or safety reasons where there are reasonable grounds to believe that safe participation cannot be ensured.
20. BREATHWORK, COACHING & 1:1 SESSIONS
Breathwork, embodiment, coaching and personal sessions may be physically and emotionally intensive. Participation is voluntary and at the participant’s own responsibility. Participants are required to inform Kairos prior to the start of the respective session of any relevant pre existing physical or mental health conditions, current treatments or other circumstances that could affect their ability to participate safely. Kairos does not guarantee any specific physical, emotional or health related outcomes.
21. LONGEVITY & WELLNESS SERVICES
Kairos offers various longevity and wellness services designed to promote relaxation, recovery and general wellbeing. The services currently available are set out in the relevant service descriptions on the website or within the booking system. Before using the respective service or equipment, customers will receive instructions from the Kairos team. Unless expressly stated otherwise, the service or treatment itself is carried out independently by the customer. All equipment and services must be used strictly in accordance with the instructions provided by the Kairos team and the applicable usage guidelines. The services offered do not constitute medical services and are not a substitute for medical diagnosis or treatment. No specific health or therapeutic outcome is guaranteed.
22. RETREATS
The scope of services included in each retreat is set out in the respective retreat description. Unless expressly stated otherwise, retreats include only the services specified in the respective service description. In particular, travel to and from the retreat, flights, travel insurance, visas and other personal expenses are not included in the contract. After the expiry of the free cancellation period specified in the respective retreat description, payments already made are generally non refundable, unless a statutory right of withdrawal or cancellation applies. Kairos reserves the right to modify individual programme elements for organisational or weather related reasons, provided that such changes do not materially alter the overall nature of the retreat. If a retreat is cancelled for reasons attributable to Kairos, any payments already made will be refunded. Any further claims shall only apply to the extent provided for by law.
23. ONLINE SHOP & WELLNESS STORE
Kairos operates both an online shop and an on site Wellness Store. For orders placed through the online shop, the statutory provisions governing distance selling shall apply in addition to these Terms and Conditions. Goods will be delivered to the delivery address provided by the customer. For consumers, the risk of accidental loss of or damage to the goods shall pass to the customer only upon delivery of the goods. The goods shall remain the property of Kairos until payment has been made in full. Purchases made at the Wellness Store are subject to the applicable statutory provisions governing in store retail purchases.
24. GIFT VOUCHERS
Gift vouchers may be purchased online or at the Wellness Store. They may be redeemed for any services offered by Kairos, unless otherwise agreed at the time of purchase. Redemption is subject to the services available at the relevant time. Gift vouchers are valid for twelve (12) months from the date of issue. Cash redemption or payment of interest on the voucher value is excluded to the extent permitted by law.
25. PHOTO & VIDEO RECORDINGS
During events, workshops, retreats or other special occasions, photographs and video recordings may be taken for public relations and corporate communications purposes. Participants will be informed separately before the respective event begins. Where required by law, the processing of photographs or video recordings containing personal data will only take place on the basis of the participant’s consent. Participants may inform the Kairos team at any time if they do not wish to be photographed or recorded in an identifiable manner.
PART 5 – FINAL PROVISIONS
26. LIABILITY
Kairos shall be liable without limitation for damages caused intentionally or through gross negligence. In cases of ordinary negligence, Kairos shall only be liable for breaches of material contractual obligations (cardinal obligations). In such cases, liability shall be limited to the typical and foreseeable damage arising from the contract. The above limitations of liability shall not apply to damages resulting from injury to life, body or health, or in any other cases in which liability is mandatory under applicable law. To the extent that the liability of Kairos is excluded or limited, this shall also apply to the personal liability of its legal representatives, employees and agents.
27. CLOAKROOM & VALUABLES
Kairos accepts no liability for clothing, personal belongings or valuables brought onto the premises, unless the loss or damage is caused by intentional misconduct or gross negligence on the part of Kairos. The use of any cloakrooms, storage areas or lockers provided is at the participant’s own risk. Participants shall be liable in accordance with the applicable statutory provisions for any damage they intentionally or negligently cause to the premises, furnishings, training equipment or other equipment provided.
28. DATA PROTECTION
Personal data is processed exclusively in accordance with the applicable data protection laws and regulations. Further information regarding the processing of personal data, data subject rights and the use of the booking platform can be found in the current Privacy Policy available on the Kairos website.
29. RIGHT OF WITHDRAWAL
Consumers generally have a statutory right of withdrawal in the case of distance contracts. Further details are set out in the separate withdrawal policy, which forms part of the respective contract. The right of withdrawal may be excluded or may expire prematurely in cases provided for by law, in particular for leisure services scheduled for a specific date or period or following the full performance of the contract.
30. FINAL PROVISIONS
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), insofar as this does not conflict with mandatory statutory consumer protection provisions. Should any individual provision of these Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The applicable statutory provisions shall apply in place of the invalid or unenforceable provision.
